Granting of Facility of Writer's Help/Extra Time to Physically/Visually Challenged Candidates in CA Exams

Procedure for Granting of Facility of Writer's Help/Extra Time to Physically/Visually Challenged Candidates in The Chartered Accountants Examinations - (21-09-2010)

Physically/Visually Challenged candidates appearing in the Chartered Accountants Examinations requiring writer’s help/extra time are requested to adopt the following procedure:

To send an application in candidate’s own hand writing if he can write. In respect of candidates who can not write, their representatives may write and forward the application.

To enclose a certified true copy of the certificate issued by the Doctor of not less than the level of Civil Surgeon of Government Hospital to the effect that the disability is of permanent nature and specifying clearly the nature and extent of Permanent disability (in terms of %age).

To enclose certified true copies of the permission, if any, granted by the State Higher Secondary Board/University in candidate’s 10th, 10+2 or degree examinations in which he/she had appeared.

To enclose an attested full size latest photograph indicating name of the candidate on the photograph itself.

Any other document in support of request for grant of the facility of a writer and/or extra time as aforementioned.

It is clarified that cases of injuries or disablement of temporary nature such as fracture of the right or left arm, forearm or dislocation of a shoulder, elbow or wrist or any other illness etc. are not entitled for extending the facility of writer/extra time.

Kindly note that one /one and a half hour (for PCE, IPCE and Final Examination), half/one hour (for CPT paper-pencil mode) extra time and/or writer’s help will be granted depending on the nature and extent of Permanent disability and in accordance with the guidelines prescribed by the Institute in this regard.

The request for extra time/writer’s help should be sent as a separate request and not be enclosed to the examination application form. The request should be sent preferably with the details of registration no. and complete postal address of the candidate.

The candidate will be informed about the grant of extra time/writer’s help by way of separate communication normally about 15 days prior to the commencement of examination.

It has been decided to revise the structure of question papers for the PCE, IPCE and Final (old and new course) examinations as under, from November, 2010 examination onwards:
1. One question will be compulsory.
2. Among other questions, one choice will be provided uniformly in all the papers.
3. In addition, in one of the questions, one internal choice may be provided as far as possible.

Online Articles Placement Portal for selection of Articled Assistants

On Line Articles Placement Portal for selection of Articled Assistants by CA Firms from 5th October, 2010

The Board of Studies of the Institute has introduced an optional Campus Placement Scheme for selection of Articled Assistants by CA Firms. The Pilot Campus Placement Programme held at Delhi in August 2010 has been a great success with an overwhelming response from both CA Firms and Students.

Considering the positive feedback and requests received from both CA Firms and Students, it has been decided to start an Online Articles Placement Portal to facilitate placement of Articles in CA Firms on pan India basis. Both eligible CA firms and candidates who are willing to avail of this facility shall have to register themselves online through the articles placement portal at http://bosapp.icai.org. The Portal would be operational from 5th October, 2010 at 11.00 A.M. onwards. The services on the Portal would be available for two months from the time of registration by the firm. Similarly the bio data of a student will also be available on the portal for a maximum period of 2 months from the date of student’s registration.

The Articles Placement Portal has been put into place to provide a platform to the firms of Chartered Accountants having vacancies for Articled Assistants to shortlist eligible students for selection of articled assistants, and call them for Interview at their offices, as per date and time convenient to them. The candidates who have either (a) Passed Group-I or both Groups of the IPCC examination, or (b) Passed either of the Groups or both groups of PE-II examination; and are eligible for undergoing articled training for selection as articled assistants in the CA firms can  register themselves on the portal, such that they can be considered for selection by the CA Firms.

The candidates shortlisted by CA Firms would be automatically informed by e-mail through the Portal, to appear for interview at their respective Offices, at the designated date and time.

Norms for Firms of Chartered Accountants participating in the Campus Placement Programme:

 All CA firms registered with the Institute and having vacancies for articled assistants are eligible to register through Portal by paying the requisite fee mentioned hereunder.

 After Registration, the participating firms would short list the candidates from the data available on the portal as per their requirement on the basis of number of vacancies available with them and call the candidates for interviews/interaction at their offices as per the suitable time and date convenient to them.

 Participating CA Firms should ensure that they have the number of vacancies available with them for articled assistants and shall have to mandatorily give offer letter to the selected candidates in writing on the date of the interview itself. (Please access ICAI website under "Know Your Firm Details" to find latest position).

 The CA firms are also requested to please see the list of candidates already selected by other CA firms on the Portal before giving offer letters to the candidates.

 The services on the Portal would be available for two months from the time of registration by the firm. Similarly the bio data of a student will also be available on the portal for a maximum period of 2 months from student’s registration.

Scale of Fee to be Charged From the Participating CA Firms:

CA Firms making use of the above Portal are required to pay through the Payment Gate way at the following rates to cover costs of the Portal, etc.:
Proprietorship Firms Rs. 1,000/-
Partnership Firms up to 6 partners Rs. 1,500/-
Partnership Firms having 7 to 12 partners Rs. 2,000/-
Partnership Firms having more than 12 partners Rs. 3,000/-
(Please add applicable Service Tax @ 10.3%)

Guidelines for CA Students:

 CA students who have qualified either (a) Passed Group-I or both Groups of the IPCC examination, or (b) Passed either of the Groups or both groups of PE-II examination and are eligible for undergoing articled training can apply for registration through Portal.

 The participating firms would short list the candidates registered on the Portal as per their requirement and call the candidates for interviews/interactions as per date and time convenient to them at their offices.

 If the date and/or time given by the CA firm is clashing with date and/or time of other CA firm(s), the candidate concerned is required to intimate the other firm(s) about the clash of date and time and request the firm(s) to change the same as per mutual convenience.

 Candidates appearing for the interviews are required to carry proof of their identity along with a copy of the mark-sheet(s) relating to IPCC/PE-II Examination, duly attested by a Chartered Accountant or a Gazetted Officer.

 Each student who would be given letter by the CA firm for pursuing articled training is required to give acceptance to the firm within 7 days’ time.

 In case the consent as per consent form is given by the Article to the firm this will be irrevocable from both sides and student will not be registered by ICAI under any other CA firm without the consent of the firm who were originally given the consent.

 After giving consent to the CA firm, he shall be required to indicate about his selection at the appropriate place on the Portal so that he should not be invited for further interviews by the CA firms.

 Students are advised to follow the proper Dress Code as prescribed by the Institute while appearing for interviews/interactions.

Transfer/Termination of Articleship

[Regulation 56(1)]

In partial modification of the announcement dated 30th June 2009 regarding transfer / termination of articles the Council in its recent meeting has decided that the transfer/termination of articleship in terms of Regulation 56(1) of the Chartered Accountants Regulations, 1988 shall be permissible on the grounds as stated below: -

I. Transfer /termination of articles is permitted without any restriction during the first year of articles.

II. During rest of the articleship period on satisfying any one or more of the conditions as stated below: -

1. Medical grounds requiring discontinuance of articles for a minimum period of three months (on production of a Medical Certificate issued by a Government Hospital).
2. Transfer of parent(s) to another city.
3. Misconduct involving moral turpitude.
4. Other justifiable circumstances / reasons: -

(ii) Grounds already permissible in the Chartered Accountants Regulations, 1988 (on submission of requisite proof of the act warranting transfer/termination of articleship): -
a. Industrial Training (Regulation 51)
b. Secondment of articles (Regulation 54)
c. Conversion from PCC to IPCC (for termination of articles only. Re-registration of articles to be allowed only after passing Group-I of IPCC)
d. Death of Principal [Regulation 57(1)(c)]
e. Ceasing of practice by the Principal [Regulation 57(1)(a)]
f. Removal of name of the Principal from the Register of Member due to any reason [Regulation 57(1)(b)]

(iii) Marriage basis (only if there is relocation to another city involving distance of 50 kms).

(iv) Irregular payment or non payment of stipend with reference to Regulation 67.

(v) Articled assistant desires to serve balance period of training outside India.

(vi) Shifting by the Principal to another city involving distance more than 50 kms.
The articled assistants are required to get the consent of the Institute before getting Form 109 signed
by the Principal in their own interest.

The request, on any one or more of the aforesaid grounds, of an articled assistant on a plain paper alongwith the recommendation/ consent of the Principal for transfer / termination of articleship accompanied by evidence/proof (self-attested by the articled assistant) to the satisfaction of the Institute be made. Request for transfer not accompanied by consent of Principal shall not be accepted.

In case of dispute between principal and articled assistant, the matter be settled amicably among the articled assistant and the principal concerned and the Institute shall not interfere in such cases.

Important Announcement: Relaxation of 9 months study course period to converted to IPCC students. - (08-02-2010)

An Important Announcement for Students of Erstwhile Intermediate/ Professional Education (Course – II)/ Professional Competence Course (PCC) who have mean while converted to Integrated Professional Competence Course (IPCC) – relaxation of nine months study course period to appear in the Integrated Professional Competence Course (IPCC) examination to be held in May, 2010 and onwards.

Eligibility to appear in the May, 2010 and onwards Integrated Professional Competence Examination (IPCE):
All students who have been registered for the erstwhile Intermediate under paragraph 2 or 2 A of schedule B to the Chartered Accountants Regulations 28 or who have been registered for the erstwhile Professional Education (Course-II) or who have been registered for the Professional Competence Course (PCC) are eligible for conversion to Integrated Professional Competence Course (IPCC) by paying the prescribed conversion fee along with the conversion application form obtained along with IPCC prospectus or downloaded from http://www.icai.org/resource_file/14262ipcc_re_regform.pdf - IPCC Re-Registration Form to be submitted to the concerned Regional Office for becoming eligible to appear in the May, 2010 and onwards examination before last date for submission of examination application form as notified from time to time.

Students so converted from erstwhile Intermediate/ Professional Education (Course – II)/ Professional Competence Course to Integrated Professional Competence Course (IPCC) and have completed minimum period of nine months from the date of registration in Intermediate/ Professional Education (Course – II) or completed nine months after joining the Professional Competence Course are permitted to appear in the Integrated Professional Competence Examination to be held in May, 2010 and onwards. However, they should successfully complete 35 hours Orientation Programme and also 100 hours Information Technology Training before the commencement of relevant Integrated Professional Competence Examination (IPCE).

Breach of Regulation 65 & 78 – Non submission of Form 112 - (08-01-2010)

In partial modification of the guidelines as contained in the Announcement dated 14th September 2009, it is hereby notified for the information of all concerned that the Council, in its 291st meeting held on 16th and 17th December 2009, has decided that delay in submission of Form 112 for having done additional / other course alongwith articleship through correspondence mode of study/private student (where there was no requirement of attending any classes at all)/early morning classes/evening classes (with no clash/overlapping between office and teaching hours) be condoned by taking a liberal view of the lapse on the part of the students concerned and membership be granted, as an amnesty measure for all such requests already received or to be received upto 31st March 2010.

However, for additional/other course pursued during day time classes along with articleship, two or more courses at a time alongwith articleship and / or where there is overlapping between working and teaching hours, the Council decided that each such case will be individually considered by the Executive Committee in the light of its decision taken at its 486th meeting held on 21st August 2009 and delay may be condoned and membership may be granted by imposing certain condition(s), as it may deem fit, to be fulfilled by the students concerned before enrollment as a member.

It is notified that wherever any statement made by a student or member is found to be false or varying with the facts discovered during the scrutiny process or later at any stage, the student and/ or member concerned will be liable to be proceeded with in accordance with the Chartered Accountants Act, 1949 and Regulations/Rules framed thereunder.

It was further decided that the student / articled assistants who have not yet taken permission for pursuing a course of study – whether academic or professional – alongwith articleship are advised, in their own interest, to submit Form 112 (can be downloaded from www.icai.org) so as to reach the concerned regional office of the Institute at Mumbai, Chennai, Kolkata, Kanpur or New Delhi, as the case may be, on or before 31st March 2010.

No request for condonation of breach of Regulation 65 & 78 for delay in submission of Form 112 will be considered effective from 1st April 2010.

ACCOUNTING TECHNICIAN CERTIFICATE (24-12-2009)

In terms of Regulation 37C(3) of the Chartered Accountants Regulations, 1988, a student who has passed Intermediate or Professional Education-II Examination or Professional Competence Examination and also completed the prescribed period of articled training is eligible for grant of Accounting Technician Certificate. Such a student would continue to be eligible to appear in the Final Examination.

We have in last month issued letters to such eligible students inviting them to opt for grant of such a Certificate. However, to our utter dismay, it has been noted that such letters have also been inadvertently issued to our esteemed members, perhaps due to incomplete/mix up of data base.

We sincerely regret the mistake and convey our apologies for the inconvenience caused. We request that our letter, in question, may kindly be treated as cancelled and withdrawn.
